Welcome to TICOASIS.
We are delighted you have chosen to stay with us and look forward to providing you with a relaxing, memorable, and authentic Costa Rican experience. TICOASIS is a boutique eco-resort designed to offer guests exceptional accommodations while respecting the natural beauty, wildlife, and tranquility that make Marbella, Guanacaste such a special destination.
To help ensure an enjoyable experience for every guest, this Guest Rental Agreement establishes the terms governing your reservation and stay at TICOASIS. These terms are intended to protect both our guests and the resort while promoting a safe, peaceful, and enjoyable environment for everyone.
By completing a reservation, the individual making the reservation ("Reservation Holder") acknowledges that they have read, understood, and agree to be legally bound by this Guest Rental Agreement, including the Resort Terms & Conditions, Cancellation Policy, and Guest Policies incorporated herein. The Reservation Holder further represents that they have authority to accept this agreement on behalf of every individual included in the reservation and accepts responsibility for ensuring that all members of their party comply with its terms.
Failure to comply with this Guest Rental Agreement may result in additional charges, cancellation of the reservation, removal from the property without refund, or other remedies permitted by applicable law.
Definitions
For purposes of this Guest Rental Agreement, the following terms shall have the meanings set forth below:
Accommodation refers to the bungalow, suite, room, or other lodging unit reserved by the Reservation Holder.
Common Areas means all portions of the resort available for shared guest use, including but not limited to the swimming pool, walkways, parking areas, landscaped grounds, and other recreational or guest amenities.
Guest means every individual occupying or visiting the resort under a confirmed reservation.
Property refers to the real property, buildings, improvements, landscaping, and facilities comprising TICOASIS.
Reservation Holder means the individual who completes the reservation and accepts this Guest Rental Agreement on behalf of all guests included in the reservation.
Resort means TICOASIS, including all accommodations, common areas, amenities, and surrounding property owned or operated by TICOASIS.
TICOASIS, we, our, and us refer to the owners, management, employees, contractors, and authorized representatives of TICOASIS.
Throughout this agreement, words used in the singular include the plural where appropriate, and words of one gender include all genders where the context requires.
Reservations
Reservations may be made directly through the TICOASIS website or through approved third-party booking platforms.
A reservation is considered confirmed only after all of the following have occurred:
- The reservation request has been accepted by TICOASIS.
- Required payment has been successfully processed.
- The guest receives a written confirmation by email.
- The Reservation Holder agrees electronically to this Guest Rental Agreement.
TICOASIS reserves the right to refuse or cancel any reservation that contains inaccurate information, violates these policies, exceeds occupancy limitations, or cannot be accommodated due to circumstances beyond the resort's reasonable control.
Reservations may not be transferred to another individual without the prior written approval of TICOASIS.
Guests must be at least twenty-five (25) years of age to make a reservation unless otherwise approved in writing by TICOASIS. The Reservation Holder must remain on the property for the duration of the reservation.
Rates & Payments
All published rates are quoted in United States Dollars (USD) unless otherwise stated.
Applicable taxes, governmental fees, resort fees, and any additional charges required by Costa Rican law will be disclosed during the reservation process.
Unless otherwise stated at the time of booking, payment schedules are as follows:
- Any required deposit is due at the time the reservation is confirmed.
- Any remaining balance must be paid by the date specified during the reservation process.
- Reservations not paid in accordance with the published payment schedule may be cancelled without further notice.
TICOASIS reserves the right to correct pricing errors, typographical mistakes, or obvious system errors prior to reservation confirmation.
Accepted methods of payment will be displayed during the booking process.
Chargebacks initiated without a legitimate basis under applicable consumer protection laws may constitute a breach of this agreement. TICOASIS reserves all legal rights to dispute fraudulent or improper chargebacks and recover associated costs where permitted by law.
Cancellation Policy
TICOASIS understands that travel plans occasionally change. The following cancellation policy has been established to balance flexibility for our guests with the operational requirements of a boutique resort.
Standard Direct Reservations
Reservations made directly with TICOASIS are subject to the following cancellation terms:
24-Hour Grace Period
Reservations may be cancelled within twenty-four (24) hours of booking for a full refund, provided the reservation was made at least seventy-two (72) hours before the scheduled arrival date.
After the expiration of the grace period:
- More than thirty (30) days before arrival: Full refund.
- Fifteen (15) to thirty (30) days before arrival: Fifty percent (50%) refund of amounts paid.
- Fourteen (14) days or fewer before arrival: No refund.
Refunds, when applicable, will be processed using the original payment method whenever reasonably possible.
No refunds will be provided for:
- No-shows.
- Late arrivals.
- Early departures.
- Unused nights.
- Weather-related changes of personal travel plans except as required by law or specifically provided elsewhere in this agreement.
Modifying reservation dates does not reset or extend applicable cancellation periods.
Costa Rican Resident Last-Minute Rate
The Costa Rican Resident Last-Minute Rate is a special promotional rate offered exclusively to verified Costa Rican residents for reservations made within eighteen (18) days of arrival.
Because this rate reflects substantial last-minute pricing discounts, it is subject to the following additional conditions:
- Reservations are non-refundable immediately upon confirmation.
- No cancellations are permitted.
- No changes to travel dates are permitted.
- No credits or future stay vouchers will be issued.
- Guests must present valid Costa Rican government-issued residency identification upon check-in.
- Failure to verify residency may result in cancellation of the reservation or payment of the difference between the promotional rate and the standard published rate.
This promotional rate may be modified, suspended, or discontinued by TICOASIS at any time without prior notice.
Third-Party Reservations
Reservations made through Airbnb, VRBO, Booking.com, Expedia, or any other third-party booking platform remain subject to the cancellation policies of that platform.
To the extent permitted by those platforms, TICOASIS will honor the applicable platform policies. In the event of any conflict between this agreement and a third-party booking platform's cancellation policy, the platform's published cancellation policy shall govern that reservation.
Travel Insurance
Guests are strongly encouraged to purchase comprehensive travel insurance covering trip cancellations, interruptions, medical emergencies, evacuation, baggage loss, and unforeseen travel disruptions.
TICOASIS shall not be responsible for financial losses resulting from circumstances that could reasonably have been covered through travel insurance.
Arrival & Departure
To ensure a smooth arrival and departure experience for all guests, the following procedures apply unless otherwise confirmed in writing by TICOASIS.
Check-In
Standard check-in begins at 3:00 PM on the scheduled arrival date.
Prior to arrival, guests will receive check-in instructions, property access information, and any applicable electronic access credentials necessary to access the resort.
Early check-in requests are subject to availability and cannot be guaranteed. If approved, additional fees may apply.
The Reservation Holder may be required to provide valid government-issued identification prior to or upon arrival for identity verification purposes.
Reservations made under the Costa Rican Resident Last-Minute Rate require verification of Costa Rican residency at check-in. Failure to provide acceptable documentation may result in cancellation of the promotional rate or payment of the difference between the discounted rate and the standard published rate.
TICOASIS reserves the right to deny occupancy when:
- Required identification cannot be verified.
- Payment obligations have not been satisfied.
- The number of arriving guests exceeds the permitted occupancy.
- Fraudulent information has been provided.
- Occupancy would violate this Guest Rental Agreement or applicable law.
Check-Out
Standard check-out time is 11:00 AM on the scheduled departure date.
Late check-out requests must be approved in advance and are subject to availability. Unauthorized late departures may result in additional charges.
Prior to departure, guests agree to:
- Lock all doors and windows.
- Turn off lights, ceiling fans, air conditioning units, televisions, and other unnecessary electrical appliances.
- Leave all used towels on the floor inside the bungalow.
- Dispose of all trash from the bungalow in the designated refuse containers located outside the resort entrance gate.
- Remove all personal belongings.
- Leave the accommodation in a reasonably clean and orderly condition.
Guests are not expected to wash dishes, launder linens, strip beds, or perform housekeeping duties beyond the reasonable expectations described above.
Items left behind after departure may be considered abandoned property. TICOASIS will make reasonable efforts to notify guests of valuable items that are recovered; however, retrieval, shipping, insurance, and associated costs remain the responsibility of the guest. TICOASIS is under no obligation to store abandoned property for any specific period of time.
Guest Access Credentials
To provide a secure and convenient self-check-in experience, TICOASIS utilizes electronic smart locks, electronic gate access systems, and other digital access technologies.
Each reservation is assigned unique electronic access credentials, which may include door codes, gate codes, or other electronic methods of entry.
Guests acknowledge and agree that:
- Access credentials are issued exclusively for the registered guests associated with the reservation.
- Access credentials are confidential and may not be shared with individuals who are not registered occupants without prior written approval from TICOASIS.
- Access credentials automatically activate at the designated check-in time and automatically expire at the scheduled check-out time unless otherwise authorized.
- The Reservation Holder is responsible for all activity occurring through the use of their assigned access credentials.
- Lost, stolen, or compromised access credentials should be reported immediately.
- TICOASIS reserves the right to modify, suspend, or deactivate access credentials whenever reasonably necessary to protect the safety, security, or operation of the resort.
Tampering with electronic locks, access control devices, gates, security equipment, or surveillance systems is strictly prohibited.
Occupancy
The maximum occupancy for each accommodation is established for the safety and comfort of all guests and in accordance with applicable building, fire safety, and operational standards.
Only registered guests identified on the reservation may occupy the accommodation overnight.
Visitors who are not registered overnight guests may be permitted only with prior approval from TICOASIS and must comply with all resort policies while on the property.
Unauthorized overnight guests may result in:
- Additional occupancy charges.
- Immediate cancellation of the reservation.
- Removal from the property without refund.
- Liability for any resulting damages or losses.
Subletting, assigning, transferring, or advertising accommodations to other individuals is prohibited without prior written authorization from TICOASIS.
Guest Responsibilities
The Reservation Holder accepts responsibility for the conduct of every individual included within the reservation, including invited visitors approved by TICOASIS.
Guests agree to:
- Treat the accommodations, furnishings, landscaping, and resort amenities with reasonable care.
- Respect other guests' privacy and enjoyment of the property.
- Comply with all posted resort signage and staff instructions.
- Promptly report maintenance issues or safety concerns.
- Supervise children at all times.
- Exercise reasonable care while using all resort facilities.
Guests are expected to behave respectfully toward employees, contractors, neighbors, and other visitors.
Abusive, threatening, discriminatory, harassing, or violent conduct toward staff or other guests will not be tolerated and may result in immediate removal from the property without refund.
Property Damage
Guests are responsible for any damage to accommodations, furnishings, fixtures, appliances, landscaping, equipment, or resort property caused by themselves, members of their party, or their visitors beyond ordinary wear and tear.
Damage includes, but is not limited to:
- Broken furniture.
- Damaged doors or windows.
- Stained linens or towels beyond normal use.
- Missing items.
- Excessive cleaning requirements.
- Damage caused by negligence, misuse, or intentional acts.
If extraordinary cleaning, repairs, replacement of property, or restoration services become necessary, the Reservation Holder agrees to reimburse TICOASIS for all reasonable costs incurred.
If damage renders an accommodation temporarily unavailable for future reservations, the Reservation Holder may also be responsible for reasonable lost rental revenue during the period the accommodation cannot be occupied, to the extent permitted by applicable law.
Guests should immediately report accidental damage so that repairs can be arranged promptly and additional damage can be minimized.
Reporting Damage
Guests are encouraged to promptly report accidental damage, maintenance concerns, or operational issues as soon as they are discovered.
TICOASIS recognizes that genuine accidents occasionally occur during travel. Prompt reporting allows repairs to be completed quickly, often preventing additional damage and minimizing inconvenience to future guests.
The timely reporting of accidental damage will always be viewed more favorably than damage that is concealed or discovered only after departure.
Failure to report known damage may be considered when assessing responsibility for repair costs.
Quiet Enjoyment
TICOASIS is intentionally designed as a peaceful boutique resort where guests can relax and enjoy the natural beauty of Costa Rica.
Guests agree to conduct themselves in a manner that respects the comfort, privacy, and quiet enjoyment of others.
Quiet hours are observed daily from 10:00 PM until 8:00 AM.
During quiet hours, guests shall refrain from:
- Loud conversations.
- Amplified music.
- Television or audio systems at excessive volume.
- Parties or gatherings that disturb neighboring accommodations.
- Any conduct that unreasonably interferes with another guest's enjoyment of the resort.
Persistent disturbances may result in warnings, additional charges, or removal from the property without refund.
Smoke-Free Resort
TICOASIS is a smoke-free resort.
Smoking of any kind is prohibited within:
- All guest accommodations.
- Patios.
- Balconies.
- Pool areas.
- Walkways.
- Parking areas.
- Common areas.
- All other indoor and outdoor portions of the resort property.
Electronic cigarettes and vaping devices may only be used in specifically designated outdoor areas, if such areas are provided by TICOASIS.
Guests who violate this policy may be charged for:
- Additional cleaning.
- Deodorization.
- Upholstery or linen treatment.
- Damage remediation.
- Temporary loss of rental revenue if the accommodation cannot be rented due to smoke odor or related damage.
Repeated violations may result in immediate termination of the reservation without refund.
Pets
To maintain the comfort of all guests and preserve the condition of the accommodations, pets are not permitted anywhere on the TICOASIS property.
The only exception is for verified service animals that are required by applicable law.
Guests traveling with a service animal are encouraged to notify TICOASIS before arrival so appropriate accommodations can be made.
Service animals must remain under the control of their handler at all times and may not be left unattended within the accommodations or elsewhere on the property.
Guests are responsible for any damage, extraordinary cleaning, or repairs resulting from the presence of a service animal.
Animals whose sole function is to provide comfort or emotional support, but which are not recognized as service animals under applicable law, may be declined to the extent permitted by law.
Pool & Common Areas
The swimming pool and all common areas are provided exclusively for the enjoyment of registered guests.
Guests use all recreational facilities entirely at their own risk.
No lifeguard is on duty.
Children must be supervised by a responsible adult at all times while using the pool or surrounding areas.
Guests agree to observe all posted safety rules and to use reasonable care while enjoying resort amenities.
The following activities are prohibited in or around the pool:
- Running.
- Diving.
- Rough play.
- Glass containers.
- Illegal substances.
- Any behavior creating an unreasonable safety risk.
TICOASIS reserves the right to temporarily close the pool or any common area for maintenance, weather conditions, safety concerns, or other operational reasons without compensation.
Events & Gatherings
TICOASIS is designed as a boutique retreat intended to provide a peaceful environment for all guests.
Unless expressly approved in writing by TICOASIS, the resort may not be used for:
- Parties.
- Weddings.
- Receptions.
- Corporate events.
- Retreats.
- Classes.
- Commercial gatherings.
- Large social functions.
- Any activity that exceeds the occupancy or intended use of the property.
Unauthorized events may result in immediate cancellation of the reservation, removal from the property, and assessment of additional fees for damages, excessive cleaning, security, or operational disruption.
Approval of any special event remains solely at the discretion of TICOASIS and may require additional agreements, deposits, insurance, or event-specific fees.
Wildlife & Environmental Stewardship
One of the unique characteristics of TICOASIS is its natural setting within Costa Rica's extraordinary ecosystem.
Guests may encounter native wildlife including birds, monkeys, iguanas, butterflies, insects, and other species commonly found in tropical environments.
Guests agree to respect the natural environment by:
- Observing wildlife from a safe distance.
- Never feeding wild animals.
- Never attempting to capture, handle, or disturb wildlife.
- Remaining on established walkways whenever practical.
- Respecting native vegetation.
- Avoiding unnecessary damage to plants or natural habitats.
Guests understand that wildlife encounters are a natural part of the Costa Rican experience and acknowledge that TICOASIS cannot control the presence or behavior of native animals.
TICOASIS shall not be responsible for inconvenience, property damage, or personal injury resulting from normal wildlife activity except as required by applicable law.
Sustainability
Environmental stewardship is central to the TICOASIS experience.
Guests are encouraged to help preserve Costa Rica's natural beauty through responsible use of resort resources.
We respectfully ask guests to:
- Turn off lights when leaving the accommodation.
- Turn off air conditioning whenever practical while away from the bungalow.
- Conserve water whenever possible.
- Dispose of waste responsibly.
- Use recycling facilities when provided.
- Respect local wildlife and ecosystems.
These simple efforts help reduce environmental impact while preserving the beauty of TICOASIS for future guests.
Internet & Technology Services
Wireless internet service is provided as a complimentary amenity for guest convenience.
Although TICOASIS strives to provide reliable internet connectivity, uninterrupted service cannot be guaranteed due to factors beyond the resort's reasonable control, including weather conditions, utility interruptions, equipment failures, or service provider outages.
Guests agree not to:
- Access illegal content.
- Attempt unauthorized access to resort systems or networks.
- Download or distribute malicious software.
- Interfere with network performance.
- Engage in unlawful online activity while using the resort's internet services.
TICOASIS reserves the right to restrict or suspend internet access when necessary to protect network security or comply with applicable law.
Guests should not rely upon internet availability for mission-critical business activities, emergency communications, or other purposes requiring uninterrupted connectivity.
Privacy & Data Collection
TICOASIS respects the privacy of its guests and is committed to handling personal information responsibly.
By making a reservation, guests acknowledge that TICOASIS may collect, use, store, and process personal information necessary to:
- Confirm and manage reservations.
- Process payments.
- Verify guest identity.
- Issue electronic access credentials.
- Communicate before, during, and after a stay.
- Provide guest support.
- Comply with legal and regulatory requirements.
- Improve guest services and resort operations.
Personal information may be processed through trusted third-party service providers, including reservation management platforms, payment processors, electronic access control systems, communication services, and other hospitality technology providers acting on behalf of TICOASIS.
TICOASIS does not sell guest personal information to third parties.
Additional information regarding the collection and use of personal information is available in the TICOASIS Privacy Policy, which is incorporated herein by reference.
Maintenance & Emergency Entry
TICOASIS is committed to maintaining all accommodations in excellent condition throughout each guest's stay.
Guests agree to promptly notify TICOASIS of:
- Plumbing leaks.
- Electrical issues.
- Malfunctioning appliances.
- Damage.
- Security concerns.
- Safety hazards.
- Any condition requiring maintenance.
Prompt reporting helps minimize damage and allows repairs to be completed as quickly as possible.
TICOASIS reserves the right to enter any accommodation when reasonably necessary to:
- Perform requested maintenance.
- Address emergency conditions.
- Prevent property damage.
- Protect guest safety.
- Inspect suspected violations of this Guest Rental Agreement.
- Comply with applicable law.
Whenever practical, reasonable notice will be provided before non-emergency entry.
Immediate entry without prior notice may occur when necessary to respond to emergencies involving safety, security, fire, flooding, medical situations, or protection of resort property.
Personal Property
Guests remain solely responsible for their personal belongings throughout their stay.
TICOASIS is not responsible for the loss, theft, damage, or misplacement of personal property, including but not limited to:
- Cash.
- Jewelry.
- Electronics.
- Passports.
- Travel documents.
- Cameras.
- Luggage.
- Sporting equipment.
- Motor vehicles.
- Bicycles.
- Personal recreational equipment.
Guests are encouraged to keep accommodations secured whenever they are unattended and to exercise reasonable care with valuables.
Any property recovered after departure may be handled in accordance with the Lost Property provisions contained in this Agreement.
Illegal Activities & Prohibited Conduct
TICOASIS is committed to providing a safe, peaceful, and lawful environment for all guests, employees, contractors, and neighboring property owners.
The following activities are strictly prohibited anywhere on the resort property:
- Any activity that violates the laws of the Republic of Costa Rica.
- Possession, manufacture, distribution, or use of illegal drugs.
- Human trafficking or exploitation of any kind.
- Prostitution or solicitation.
- Physical violence, threats, intimidation, or harassment.
- Theft, vandalism, or intentional property damage.
- Possession of illegal weapons or explosives.
- Fireworks or explosive devices.
- Open fires, bonfires, fire pits, candles, lanterns, or other open flames unless specifically authorized by TICOASIS.
- Excessive intoxication resulting in unsafe or disruptive behavior.
- Disorderly conduct that interferes with the enjoyment or safety of others.
- Tampering with security equipment, smart locks, gates, surveillance systems, smoke detectors, fire extinguishers, or emergency equipment.
- Any activity that creates an unreasonable risk of injury or property damage.
Violation of this section may result in immediate termination of the reservation, removal from the property without refund, notification of law enforcement authorities, and recovery of any damages permitted by applicable law.
Photography & Commercial Use
TICOASIS is intended for personal recreational lodging and enjoyment.
Without prior written authorization, guests may not use the resort or any portion of the property for:
- Commercial photography.
- Film production.
- Advertising.
- Product promotion.
- Professional photo shoots.
- Social media influencer campaigns conducted for compensation.
- Workshops.
- Classes.
- Corporate retreats.
- Commercial events.
- Any revenue-generating activity.
Casual personal photography and videography taken during a guest's stay for non-commercial purposes are welcome.
TICOASIS may occasionally photograph or record common areas of the resort for marketing, promotional, or operational purposes. No guest will be intentionally identified in promotional materials without their prior consent except where permitted by applicable law or when individuals appear only incidentally as part of a broader public scene.
Health & Safety
Guests are responsible for exercising reasonable care while using the accommodations and resort amenities.
By choosing to stay at TICOASIS, guests acknowledge that travel to tropical environments may involve inherent risks, including but not limited to:
- Uneven walking surfaces.
- Wet or slippery conditions.
- Wildlife encounters.
- Insects.
- High temperatures.
- Heavy rainfall.
- Ocean conditions.
- Tropical vegetation.
- Temporary utility interruptions.
Guests agree to use reasonable judgment and personal responsibility throughout their stay.
Parents and guardians are solely responsible for supervising children at all times.
Guests should immediately report any unsafe condition observed on the property.
Assumption of Risk
Guests acknowledge that travel to Costa Rica and participation in outdoor recreational activities involve certain inherent risks that cannot be completely eliminated despite reasonable care by TICOASIS.
These risks may include, without limitation:
- Uneven walking surfaces.
- Wet or slippery conditions.
- Wildlife encounters.
- Insects and tropical vegetation.
- Swimming pool use.
- Ocean conditions.
- High temperatures.
- Heavy rainfall.
- Utility interruptions.
- Transportation delays.
- Other naturally occurring environmental conditions.
By voluntarily choosing to stay at TICOASIS, guests knowingly assume the ordinary risks associated with these activities and environments.
Nothing contained in this section limits any legal rights that cannot be waived under applicable law or relieves TICOASIS of responsibility for obligations imposed by applicable law.
Medical Emergencies
TICOASIS is not a medical facility and does not provide medical services.
In the event of illness or injury, guests authorize TICOASIS to contact local emergency responders if resort personnel reasonably believe emergency medical assistance is necessary.
Guests remain solely responsible for:
- Medical expenses.
- Ambulance transportation.
- Hospital charges.
- Travel interruptions.
- Insurance claims.
- Any costs associated with emergency treatment.
TICOASIS makes no guarantee regarding the availability or response time of emergency medical services.
Right to Refuse Service
TICOASIS reserves the right to refuse or terminate accommodations whenever reasonably necessary to protect the safety, security, reputation, or peaceful operation of the resort.
Circumstances that may result in refusal or termination include, but are not limited to:
- Violation of this Guest Rental Agreement.
- Fraudulent reservations.
- Non-payment.
- Unauthorized occupancy.
- Illegal activity.
- Dangerous or abusive behavior.
- Excessive disturbance of other guests.
- Significant property damage.
- Failure to comply with reasonable instructions from resort management.
When removal from the property becomes necessary due to a guest's violation of this agreement, refunds shall not be provided unless otherwise required by applicable law.
Nothing in this section limits any additional legal remedies available to TICOASIS.
Force Majeure
TICOASIS shall not be liable for delays, interruptions, cancellations, or inability to perform its obligations when caused by circumstances beyond its reasonable control.
Such circumstances may include, but are not limited to:
- Hurricanes.
- Tropical storms.
- Flooding.
- Earthquakes.
- Landslides.
- Wildfires.
- Pandemics.
- Epidemics.
- Government actions.
- Civil unrest.
- Labor disputes.
- Utility failures.
- Internet outages.
- Transportation disruptions.
- Acts of terrorism.
- Other force majeure events recognized under applicable law.
Except where otherwise required by law, such events shall not create any obligation for TICOASIS to provide compensation for consequential losses, travel expenses, or unused portions of reservations.
Guests are strongly encouraged to purchase comprehensive travel insurance.
Limitation of Liability
To the fullest extent permitted by applicable law, TICOASIS shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to a guest's reservation or stay.
Nothing in this agreement shall exclude or limit liability where such exclusion is prohibited by applicable law, including liability resulting from gross negligence, willful misconduct, or other non-waivable legal obligations.
Guests acknowledge that participation in recreational activities and use of resort facilities involve inherent risks that cannot be entirely eliminated.
Indemnification
The Reservation Holder agrees to indemnify, defend, and hold harmless TICOASIS, its owners, directors, officers, employees, contractors, agents, and affiliates from claims, liabilities, damages, losses, costs, and reasonable legal expenses arising from:
- Violations of this Guest Rental Agreement.
- Negligent or intentional acts by members of the reservation party.
- Property damage.
- Injury caused by guests or their visitors.
- Unauthorized activities conducted during the reservation.
This obligation survives the conclusion of the guest's stay to the extent permitted by applicable law.
Governing Law
This Guest Rental Agreement shall be governed by and interpreted in accordance with the laws of the Republic of Costa Rica.
Any dispute arising from or relating to this agreement shall be subject to the jurisdiction of the competent courts of Costa Rica unless applicable law requires otherwise.
Before initiating legal proceedings, both parties agree to make reasonable good-faith efforts to resolve disputes through direct communication whenever practical.
Severability
If any provision of this Guest Rental Agreement is determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
Any unenforceable provision shall be interpreted, modified, or replaced to the minimum extent necessary to preserve its intended purpose while remaining consistent with applicable law.
Changes to this Agreement
TICOASIS reserves the right to update or modify this Guest Rental Agreement from time to time.
The version in effect at the time a reservation is confirmed shall govern that reservation unless changes are required by applicable law or are accepted by the Reservation Holder.
The most current version will always be available on the TICOASIS website.
Entire Agreement
This Guest Rental Agreement, together with the applicable reservation confirmation, Privacy Policy, Cancellation Policy, and any written policies expressly incorporated by reference, constitutes the entire agreement between the Reservation Holder and TICOASIS regarding the guest's stay.
No verbal statement, marketing material, website description, social media content, or prior communication shall modify this agreement unless confirmed in writing by an authorized representative of TICOASIS.
The failure of TICOASIS to enforce any provision of this agreement on one occasion shall not constitute a waiver of its right to enforce that provision or any other provision in the future.
Electronic Acceptance
By completing a reservation through the TICOASIS website or an authorized booking platform, the Reservation Holder acknowledges and agrees that:
- They have had the opportunity to read this Guest Rental Agreement in its entirety.
- They understand and accept all terms contained herein.
- They have authority to accept this agreement on behalf of every guest included in the reservation.
- Their electronic acceptance has the same legal force and effect as a handwritten signature to the fullest extent permitted by applicable law.
